1. About This Service

MyDutchVisa.com ("we", "us", "our") offers a digital Dutch language course (the "Course") designed to help Thai speakers prepare for the Dutch A1 Inburgering exam. The Course is delivered entirely online as a self-study web application.

2. Acceptance of Terms

By purchasing or accessing the Course, you agree to these Terms of Service. If you do not agree, do not purchase or use the Course. These terms are governed by both European Union consumer law (including EU Directive 2011/83/EU on consumer rights) and applicable Thai consumer protection law (Consumer Protection Act B.E. 2522 and related legislation).

3. License & Access

Upon successful payment, you receive a personal, non-transferable license key granting you access to the purchased course content. This license is for your personal, non-commercial use only. You may not:

• Share, resell, or transfer your license key to any other person
• Copy, redistribute, or republish any course content
• Use the content for commercial training, teaching, or resale purposes

4. Digital Content & Delivery

The Course is delivered instantly as digital content. Your license key is sent to the email address provided at checkout. We are not responsible for delivery failures caused by incorrect email addresses or spam filters. If you do not receive your key within 24 hours, contact us at support@mydutchvisa.com.

5. Course Content

We reserve the right to update, improve, or modify course content at any time. Purchased access includes all future updates to the purchased tier at no additional cost. We do not guarantee that the Course will prepare any specific student for exam success, as individual results vary.

6. Intellectual Property

All course content — including text, audio, exercises, dialogues, and structure — is the exclusive intellectual property of MyDutchVisa.com. Unauthorised reproduction or distribution is prohibited under both EU copyright law (Directive 2019/790/EU) and Thai Copyright Act B.E. 2537.

7. Availability & Technical Requirements

The Course is a browser-based web application. You are responsible for ensuring you have a compatible device and internet connection. We aim for high availability but cannot guarantee uninterrupted access due to maintenance, hosting issues, or force majeure events.

8. Privacy & Data

We collect minimal data: your email address (for license delivery) and anonymous usage data. We do not sell your personal data. For EU users, your rights under GDPR apply. For Thai users, your rights under the PDPA (Personal Data Protection Act B.E. 2562) apply. Contact us at support@mydutchvisa.com to exercise your rights.

9. Limitation of Liability

To the fullest extent permitted by law, MyDutchVisa.com shall not be liable for any indirect, incidental, or consequential damages arising from use of the Course. Our total liability shall not exceed the amount you paid for the Course.

10. Governing Law

These Terms are primarily governed by Thai law, with due respect for mandatory consumer protections applicable to EU-resident customers under EU law. Any disputes shall first be attempted to be resolved amicably. EU customers retain all statutory rights granted by EU consumer law regardless of this clause.

3. ใบอนุญาตและการเข้าใช้งาน

เมื่อชำระเงินสำเร็จ คุณจะได้รับคีย์ใบอนุญาตส่วนตัวที่ไม่สามารถโอนให้ผู้อื่นได้ การใช้งานนี้เป็นการใช้ส่วนตัวเท่านั้น ห้าม:

• แบ่งปัน ขายต่อ หรือโอนคีย์ให้บุคคลอื่น
• คัดลอกหรือเผยแพร่เนื้อหาหลักสูตร
• นำเนื้อหาไปใช้เพื่อการค้าหรือการสอนเชิงพาณิชย์

4. การส่งมอบเนื้อหาดิจิทัล

หลักสูตรนี้เป็นเนื้อหาดิจิทัลที่ส่งมอบทันทีหลังชำระเงิน คีย์ใบอนุญาตจะถูกส่งไปยังอีเมลที่ระบุในขั้นตอนการสั่งซื้อ หากไม่ได้รับภายใน 24 ชั่วโมง ติดต่อ support@mydutchvisa.com

5. เนื้อหาหลักสูตร

เราสงวนสิทธิ์ในการอัปเดตหรือปรับปรุงเนื้อหาได้ตลอดเวลา การอัปเดตทั้งหมดในระดับที่คุณซื้อจะรวมอยู่ในราคาเดิม เราไม่รับประกันผลการสอบของผู้เรียนแต่ละคน

6. ทรัพย์สินทางปัญญา

เนื้อหาทั้งหมด ได้แก่ ข้อความ เสียง แบบฝึกหัด และโครงสร้างหลักสูตร เป็นทรัพย์สินทางปัญญาของ MyDutchVisa.com การทำซ้ำหรือเผยแพร่โดยไม่ได้รับอนุญาตเป็นสิ่งต้องห้ามตาม พ.ร.บ. ลิขสิทธิ์ พ.ศ. 2537

7. ความเป็นส่วนตัวและข้อมูล

เราเก็บข้อมูลขั้นต่ำ ได้แก่ อีเมล (สำหรับส่งคีย์) และข้อมูลการใช้งานแบบไม่ระบุตัวตน เราไม่ขายข้อมูลส่วนบุคคล สิทธิของคุณภายใต้ พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล (PDPA) พ.ศ. 2562 มีผลบังคับใช้

8. การจำกัดความรับผิด

Refund Policy

Our Policy: No Refunds on Digital Content

All purchases on MyDutchVisa.com are for digital content that is made available immediately upon payment. Once your license key has been issued and the course content has been accessed or downloaded, no refunds will be provided.

This policy is in accordance with:

• EU Directive 2011/83/EU — Article 16(m): the right of withdrawal does not apply to digital content supplied on a non-tangible medium where performance has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.
• Thai Consumer Protection Act B.E. 2522 — which permits the exclusion of refunds for digital goods where full disclosure is made prior to purchase.

What You Are Purchasing

When you purchase an A1 + KNS, Complete, or A2+B1 Add-on package, you are purchasing a personal, non-transferable digital license to access course content via the MyDutchVisa.com web application. The content is immediately accessible upon receipt of your license key.

Acknowledgement at Purchase

By completing your purchase via our payment processor (Lemon Squeezy), you expressly confirm that:

• You understand the purchase is for digital content
• You consent to immediate delivery of that content
• You acknowledge that your right of withdrawal (cooling-off period) is waived upon delivery of the digital content

Exceptions — When We Will Assist

While refunds are not available, we will always help in the following situations:

• License key not received: If you did not receive your key within 24 hours, contact us and we will resend it immediately.
• Technical fault: If a documented technical error on our side prevents access, we will resolve it or issue a replacement key.
• Duplicate purchase: If you accidentally purchased the same product twice within 24 hours, contact us and we will review the case.

Free Trial

Before purchasing, we strongly encourage you to use the free trial available at mydutchvisa.com/course/. The free trial gives access to the Pronunciation module, Module 1 (Greetings), Module 2 (Numbers), and Module 4 (House & Living) — enough to evaluate the course quality and teaching style before committing to a purchase.
